Evertune, Inc. (“Evertune,” “we,” “our,” or “us”) is committed to protecting the privacy of our users and providing a safe and secure user experience. This privacy policy (“Privacy Policy”) details how information about you is collected, used, and shared when you access our website at https://www.evertune.ai (“Site” or the “Evertune Site”), our customer platforms and services, or any other property that links to this Privacy Policy, or you otherwise interact with us, as well as when we process consumer information to provide our services to our customers (all of the foregoing, our “Services” or the “Evertune Services”).

This Privacy Policy applies to all information we collect through the Evertune Services from current and former Evertune users and visitors as well as other consumers. This Privacy Policy also applies to information that our business partners share with us.

By using the Services, you acknowledge that you accept our privacy practices and policies outlined below, and you consent that we may collect, process, store, and share personal information as described in this Privacy Policy.

What Information We Collect

Evertune collects information that you provide when you use the Evertune Services. Evertune (and other parties) also automatically collect information about you when you interact with the Evertune Services. We may also collect information about you from third-party data providers including those that we partner with to support our Services to our customers.

Information You Provide

When you use the Evertune Services, you may provide information about yourself, such as your full name, email address, log-in information, preference information (such as information related to your marketing preferences), and any other information you choose to provide. We may also collect from you professional or employment-related information, such as your job title, employer information, and professional background. For example, we collect this information when you join our email list, create an account, contact us, or interact with us for any other purpose. When you place an order with us, we may also collect commercial information, such as the billing details we use to bill you for our products, your billing and payment history, and any records of products or services purchased or considered.

Automatically Collected Information

We (and other entities) also automatically collect information relating to your interactions with us and our Services. For example, we may collect information such as browser type, IP address, non-precise location, referrer, when you open an Evertune email, when you register, when you log in, the pages you visit and other activities on the Evertune Services (button click data), device type, time and date of visit, and other information we collect through the use of cookies and similar technologies. Information from Third Parties for AI Retargeting Services

Unless you interact with us directly as described above, we do not knowingly collect information that directly identifies you, such as your name or contact information. Evertune provides AI retargeting services that help customers create audiences using AI research behavior from the services (“AI Retargeting”). When we provide the AI Retargeting services to our customers, we may collect pseudonymous information associated with your browser from third parties to support the AI Retargeting services and provide you with more relevant advertising. For example, third parties may provide information about you such as unique online identifiers (such as cookie or advertising identifiers), information about your browsing history and online behavior, general location information, browser and device information, and ad reporting and delivery information.

Digital Advertising & Analytics on the Site

For our Site, we may partner with ad networks and other ad serving providers (“ Advertising Providers”) that serve ads on behalf of us and others on non-affiliated platforms. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Site and other sites or apps over time, including information about relationships among different browsers and devices. This type of advertising is known as interest-based advertising.

The Evertune Services may contain from time-to-time links to third-party websites or applications. When you use a link to go from the Evertune Services to another website or application, our Privacy Policy does not apply to third-party websites or services. We do not control the privacy practices of these third parties and take no responsibility for them. Your browsing and interactions on any third-party website or service, including those that have a link or advertisement on our website, are subject to that third party’s own rules and policies. The Services also include integrated social media tools or “plug-ins,” such as social networking tools offered by third parties. If you use these tools to share personal information or you otherwise interact with these features on the Services, those companies may collect information about you and may use and share such information in accordance with your account settings, including by sharing such information with the general public. When we provide the AI Retargeting services to our customers, we may share pseudonymous information that identifies your browser with our business partners in order to support more relevant advertising to you online.

State Privacy Rights

Specific U.S. states grant consumers certain rights under state privacy laws with respect to personal information we collect, subject to applicable exemptions and limitations. These states include: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. Evertune’s processing of personal information about consumers in order to provide the AI Retargeting services to our customers is limited to pseudonymous data, which is exempt from many of the rights described below in several states. For consumers in any state with an applicable privacy law, and for our business contacts who are California residents, this section of the Privacy Policy contains disclosures required by law and explains rights that may be available to you if no exemption applies.

When we use deidentified information, we maintain and use the information in deidentified form and do not attempt to reidentify it, except to check whether our deidentification processes satisfy the requirements of applicable law.

We process and share personal information for targeted advertising on our Site and for the AI Retargeting services but do not otherwise engage in “sales” of personal information as defined by state laws. Additionally, we do not knowingly sell or share personal information of individuals under 16. To opt out of third parties collecting data for targeted advertising on the Site, you can follow the instructions in the “Digital Advertising and Analytics on the Site” section above. Evertune’s AI Retargeting services rely on pseudonymous identifiers provided by third-party partners.

To opt out of the sale or sharing of these identifiers for the AI Retargeting services, please use the opt-out mechanisms provided by our third-party partners, which will prevent Evertune from receiving the opted-out identifiers from our partners Index Exchange and Experian.

Additionally, for individuals subject to certain state laws, if you have submitted a request that you believe we have not reasonably fulfilled, you may contact us to appeal our decision by sending an email with the subject line “Appeal” to privacy@evertune.ai.

Verification Process and Required Information

The information we use for our ad targeting services is linked solely to pseudonymous online identifiers and is not associated with your name or contact information. We may be unable to process your request related to such information. At minimum, we ask for your name and email address when submitting your request so that we can communicate with you. For California business contacts, we may ask for additional information as needed to verify your identity.

Authorized Agent

Depending on your state law, you may be able to designate an authorized agent to make requests on your behalf by verifying your identity and providing written permission to the agent to make the request for you. An authorized agent can make a request on your behalf using the method described above. Depending on the request, we may require the agent to provide us with proof that you have authorized the agent to make requests on your behalf prior to accepting requests from the agent.

Retention of Information

Evertune will retain personal information for as long as you maintain an account or, with respect to inactive accounts, for as long as necessary to fulfill the purposes for which the personal information was provided to us or, if longer, to comply with legal obligations, to resolve disputes, to enforce agreements, or to satisfy similar essential purposes.For example, we may retain certain information associated with your account for marketing purposes (unless you opt-out), record-keeping integrity, as well as to prevent fraud, collect any fees owed, enforce our terms and conditions, take actions we deem necessary to protect the integrity of our website or our users, or take other actions otherwise permitted by U.S. State and federal law.

To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we process personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. Once the retention period expires and if not otherwise required to retain information by law, we will delete or deidentify personal information.
